1. General Information and Access to the Website
This website is owned and operated by MANIA, a craft beer brand operated by Stefan Hunold, sole trader, Tax Identification Number (NIF) 278240160. These Terms and Conditions set out the terms under which you may use our website and the services provided by us. This website provides visitors with information about MANIA beers, the brewing team, available offers, and an online store. By accessing or using our website, you confirm that you have read, understood, and agree to be bound by these Terms.
To use our website and/or receive our services, you must be at least 18 years old or have reached the legal age of majority in your jurisdiction and have the legal authority, right, and freedom to use these services. You may not use this website or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.
2. Commercial Terms
When purchasing an item, you agree that: (1) you are responsible for reading the complete product listing before committing to purchase it; and (2) you enter into a legally binding contract to purchase an item when you commit to buy it and complete the checkout payment process.
3. Prices and Payment Methods
The prices charged for our products are listed on the website and include VAT at the applicable rate. Purchases may be paid for via PayPal, MB Way, bank transfer, or cash when collecting an order from our warehouse.
If payment is made via MB Way or bank transfer, the customer will receive an email containing the payment details.
We reserve the right to change product prices displayed on the website at any time and to correct pricing errors that may occur inadvertently. Additional information regarding pricing and taxes is available on the payment page.
4. Purchase Procedure
To place an order in our online store:
* Select the product you wish to purchase and click “Add to Cart”;
* After confirming the products and quantities in your cart, choose either “Complete Purchase” using PayPal or “Checkout” to complete the purchase via MB Way or bank transfer;
* Select your preferred shipping option under “Shipping”.
You may complete your purchase without creating an account on the website. Simply provide your delivery address to ensure correct delivery of your order. Even if you do not require an invoice, you must provide your Tax Identification Number (NIF), as our shipping provider requires it to process deliveries.
If you require an invoice, please request it after completing your purchase by emailing mania.beer@mania.beer and including your order number.
On the “Order Confirmation” page, you must click “Place Your Order” to complete the purchase. You will receive confirmation of your order by email.
5. Delivery of Orders
Products may be delivered either by MANIA or by an external courier service. Shipping costs will be borne by you whenever explicitly communicated before completing your order; otherwise, they will be borne by MANIA.
Orders will be delivered to the delivery address specified by you during the ordering process. MANIA shall not be liable if delivery cannot be completed due to inaccurate or false information provided by you or for reasons beyond the control of the delivery service, such as the absence of the recipient.
Orders will be delivered as quickly as possible and no later than seven business days after order confirmation.
6. Procedures in Case of a Damaged Package
As a customer, you are required to inspect your order upon receipt. If you notice any damage or irregularity, you should refuse delivery and describe the issue in as much detail as possible. These observations should be recorded on the delivery documentation provided by the courier and reported to MANIA at mania.beer@mania.beer.
7. Right to Change Offers
We may, without prior notice, modify the services, discontinue any service or feature, or impose limits on the services. We may permanently or temporarily terminate or suspend access to the services without notice and without liability for any reason.
8. Intellectual Property, Copyrights, and Logos
The Service and all materials contained or transferred therein, including, without limitation, images, text, graphics, logos, trademarks, service marks, copyrights, photographs, audio, videos, music, and all Intellectual Property Rights related thereto are the exclusive property of MANIA. Except as explicitly provided herein, nothing in these Terms shall be construed as a license in or under such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works.
9. Right to Suspend or Cancel User Account
We may terminate or suspend your access to the service permanently or temporarily without prior notice and liability for any reason, including if, in our sole and exclusive determination, you are violating any provision of these Terms or any applicable law or regulation. You may discontinue use and request cancellation of your account and/or any service at any time.
10. Indemnification
You agree to indemnify and hold MANIA harmless from any demands, losses, liabilities, claims or expenses (including attorneys' fees), made against them by any third party due to, arising out of, or in connection with your use of the site or any of the services offered on the site.
11. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall MANIA be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including, without limitation, damages for lost profits, goodwill, use of data, or other intangible losses, arising out of or related to the use of or inability to use the service.
To the maximum extent permitted by applicable law, MANIA assumes no responsibility for any (1) errors, mistakes, or inaccuracies of content; (2) personal injury or property damage of any kind resulting from your access to or use of our service; and (3) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
MANIA is not liable for any health damage that may be caused by the incorrect and improper use of products sold on the website.
12. Right to Change and Amend Terms
We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these pages periodically. When we materially change the Terms, you will be notified. Your continued use of the Site or our service after any change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the site or service.
13. Promotional emails and content
You agree to receive promotional messages and materials from time to time by mail, email or any other form of contact you may provide to us. If you do not wish to receive these promotional materials or notices - please simply notify us at any time.
14. Governance of law and dispute resolution
These Terms, the rights and remedies provided herein, and any and all claims and disputes relating thereto and/or the services, shall be governed, construed and enforced in all respects solely and exclusively in accordance with the internal laws of Portugal, without regard to its conflict of law principles. Any and all claims and disputes will be submitted to, and you consent to them being decided by, a court of competent jurisdiction located in Portugal or through dispute mediation by both parties.
